Villagers to wait longer as ruling on rights violation postponed

The ruling of an application filed by 135 former Nyamuma villagers in Serengeti District, Mara Region would now be delivered on notice in Dar es Salaam by the Land Division of the High Court of Tanzania.

The ruling, which was to be made yesterday was however, postponed to a later date to be communicated to the respective parties.

The announcement to that effect was made yesterday by a court official when the application came up for ruling.

In the Miscellaneous Land Application number 22 of 2005, Ibrahim Korosso and 134 other villagers seek an appeal on human rights violation.

The ruling, follows an earlier decision in a land case which was instituted by the villagers against the Attorney General and others.

However, the villagers lost the suit.
In the suit, the villagers had sought the Court’s intervention to order for the compensation of over 800m/- as damages for the loss they suffered when their properties were destroyed.

It is alleged that the villagers suffered the said loss due to the setting on fire of their houses and other properties by some government officers, rendering them poverty stricken, helpless and homeless.

The villagers, had alleged that they encountered the loss at the hands of both Serengeti District Commissioner Thomas Ole Loy Sabaya and Officer Commanding District Alexander Lyimo on October 12th 2001, when the entire village of Nyamuma was completely reduced to ashes.

The compensation claims were refuted by the State through their lawyers who raised a preliminary objection, among other issues, to the effect that the court had no jurisdiction, after all.
