Ubungo robbery: Nine charged with murder

Nine people, among them two Tanzania Peoples Defence Forces (TPDF) soldiers, suspected of taking part in the recent Ubungo armed theft of 150m/- appeared before Kisutu Resident Magistrate Court yesterday charged with murder.
The accused, were arraigned before Principal Resident Magistrate Michael Luguru, but the magistrate could only enter committal proceedings because the offence is of a capital nature, over which the court has no judicial powers to hear.
Murder cases are capital offences and can ordinarily be tried by the High Court or a magistrate with delegated powers as directed by the court thereto.
Senior Superintendent of Police (SSP) Charles Kenyela named the accused, who looked frail and haggard, as Juma Athman Nyundo, a driver with National Microfinance Bank, Ubungo branch in Dar es Salaam Zone; Ally Omary Lumbilumbi, also a driver with the same bank at Wami Branch and a businessman Yasini Juma.
Others were Hamis Mjaka, a Zanzibar businessman, Peter Mjata, a custodian with NMB at Bank House Branch in the City and Musa Zuberi Mustafa, a farmer.
Also accused were MT.77754 Private Nazareth Amurike and MT.76162 Private Emmanuel Lameck, both members of the TPDF, and Simon Ephata Kaaya, a messenger with NMB, Wami branch.
The prosecution dropped charges against tenth suspect, MT.18568 Staff Sergeant Mathew Elias Pallangyo, shortly before the charges were read to the other nine.
SSP Kenyela told the court that the accused jointly and together murdered D6861 Constable Abdallah at Ubungo Traffic Lights in Dar es Salaam on April 20, 2006 at about 12:30.
The second count says the accused did jointly and together murdered Ernest Manyonyi on the same day at the same place and time.
The accused were not allowed to enter any plea.
