Witness in Dr Kapingas murder case narrates torture ordeal

The third prosecution witness in the ongoing murder case of Advocate Dr Eliuterius Kapinga has told the High Court in Dar es Salaam that she and her colleague were tortured by the accused and that the lawyers death was a result of a plot concocted by one Ngosha.
The witness, Salome Fred, 22, was a house girl at late Kapingas house at the time of the tragic killing.
She told the court presided by High Court Judge Buxton Mlay yesterday that Ngosha had approached her and another house girl known by one name Joyce while at Kapingas house, telling them he wanted to carry out some kind of a deal which needed their participation too.
She said though they did not agree with him on the unknown deal they later experienced torture and mistreatment from the accused.
She said she saw the body of her former boss lying on the ground in a pool of blood at his house on the fateful day of June 10,2002 the day he was killed.
Upon seeing the body of Kapinga lying on the ground in a pool of blood I, with others started, the witness said.
When asked by the Court to identify the accused of the killing of the late Advocate, Salome identified two out the five accused persons, namely Zacharia Henry Mahushi alias Ngosha and the second accused, whom she described as short and white, as she directly pointed her finger to both of them.
Salome said before killing him, Ngosha and the other accused shut her and Joyce inside another house where the accused tied all their hands and legs with a piece of rope.
She said that was the second incident in which their hands and legs were tied on that day, which included beatings by the accused.
She said they managed to come out of the house through the help of the guards from the Knight Support Limited on hearing their shouts calling for help.
She said it was then that they were led to where the body of the deceased lay and later his wife rang.
She said the following day they were taken to the police station for identification purposes where they identified two of the accused.
Dr Kapinga was killed on June 10, 2002 at his Mbezi residence in Kinondoni District in the City.
The accused are Zacharia Henry Mahushi, alias Ngosha, Ramadhan Said Amri, alias Makuka, Goodluck Ernest Sanguwa, Ali Hamis Ngenya and a former soldier, private Cyprian Alex Nkoleta alias Alex who all denied the charge.
