Foreigner fined 240,000/- for illegal stay

An Indian national, Pallavi Burhannulin Essajee Palyin Renigwal Suchak (29) was on Thursday fined a total of 240,000/- by the Kisutu Resident Magistrates Court in Dar es Salaam, for allegedly staying in the country illegally.
Prosecuting, Immigration Officer Nico Masota alleged before Resident Magistrate Joachim Tiganga that in the first count the accused mislead immigration officers in the execution of their duties that she was a Tanzanian citizen while she knew it too well that the information was not true.
The offence is contrary to section 31(1)(d) and (2) of the Immigration Act (number. 7 of 1995).
The prosecutor alleged that the accused committed the offence on May 11, 2005 at the Immigration Office Headquarters within Ilala District in Dar es Salaam.
In the second count, the prosecutor alleged the accused, being an Indian citizen presented a false document for purposes of obtaining Tanzanian passport number AB027983 on June 25, this year.
In the third count the accused was also charged for unlawful presence in the United Republic of Tanzania.
It was also alleged in court that at the time of her arrest at the Immigration office headquarters on June 15 this year, she had neither a valid permit nor a passport allowing her to stay in the country.
The accused admitted the offence and the trial magistrate sentenced her to a fine of 20,000/-, 200,000/- and 20,000/- for each of the 1st, 2nd and 3rd counts respectively or serve 6 months in jail.
She paid the fines and was later taken to the Immigration Office for further action.
