The Minister for Lands, Housing and Human Settlement Development John Magufuli, yesterday said he would not resign over the issue of the Rose Garden plot as demanded by Kinondoni councilors in Dar es Salaam, because the owner was occupying the area legally.

Last week, the councilors demanded immediate resignation of Magufuli accusing him of issuing a building permit to Rose Garden owner without the consent of the Kinondoni Municipal authority.

However, Magufuli told journalists yesterday that the owner of Rose Garden had not trespassed because he was authorized by the Commissioner for L lands to occupy the area.

The councilors claim that Rose Garden, a famous bar in Kijitonyama suburb, has been built on a road reserve and want it pulled down.

Magufuli said if the Kinondoni Municipal authority wants to demolish the structures, it will have to compensate the owner since he followed all the laid down procedures to secure the plot.

Speaking at the municipal`s full council meeting which was chaired by the Kinondoni Municipal Mayor Salum Londa last week in Dar es Salaam, the councilors said the minister should step down for `skipping` the authority and issuing the permit without following the required procedures.
