TLP court saga: Magistrate dismisses application against Mrema

Kisutu Resident Magistrate`s Court yesterday dismissed the application made by Hamad Tau and eight other persons that had sought the court`s intervention, among other things, to restrain Augustine Mrema from withdrawing monies from the TLP`s account.

The Tanzania Labour Party (TLP) of which Mrema is its chairman, maintains an account No. 030273300 at Azikiwe\'s CRDB Bank Branch.

The applicants had made an application to the court for an injunction. In their application they had sought the court`s order to restrain Mrema from holding any general meetings pending the hearing and determination of the application.

They further asked the court to declare null and void TLP\'s national Congress held on April 3, this year.

Delivering the ruling, Resident Magistrate Adolf Mahay said the application made by the applicants against the respondent, TLP`s chairman Augustine Lyatonga Mrema, was baseless and lacked merit.

The trial magistrate held that the meeting complained about had already long been held and that the applicants` application was devoid of good reasons that could have persuaded the court to determine the matter in their favour.

The court further said restraining the operations of the TLP account could be a bewildering blow to the party itself as well as its members as transactions, much as political activities could come to a stand still for no good cause.

The applicants were Hamad Tau, Perpetua Morio, Juliet Banigwe, Esther Kapama, Salum Juma, Abass Salum, Leonisia Nyawale, Matilida Magesa and Waziri Semkiwa.

In the main case, Augustino Mrema had filed a case against 23 members of his party claiming compensation of 100m/- for defaming him to the effect that he was misusing the party’s funds. The case was adjourned to July 26, this year.
