In what appears to be a bombshell-hit-back-revelation an accused has told the court in very clear terms that he was arrested by the police simply because he had no money to bribe as his colleagues who provided kick backs to the law enforcer were not arrested.

The allegations were made on Friday by Mbaraka Ally (18) who appeared before District Magistrate Stahimili Ngawasya.

The accused was responding to a prosecution witness testimony given by D/6966 Detective Corporal Warioba against the accused.

Corporal Warioba narrated an account of how he came to arrest Mbaraka and found him being in possession of 25grams of illicit drugs.

Prosecutor: Tell the court your preoccupation.
Warioba: I am police officer No.D/6966 and my name is Warioba.

Prosecutor: What happened on April 30, this year?
Warioba: I was at Jangwani area in Kinondoni District when I saw the accused with some strange paper wrappings.

I moved close to him but he tried to run away from me. However, I managed to get hold of him.
Prosecutor: Then what happened?

Warioba: I started unwrapping the piece of paper and discovered it was iIIicit drugs.

Prosecutor: How did you know it was illicit drugs?
Warioba: I could tell from its smell because I know how illicit drug smells.

Prosecutor: Have you ever learned anything about drugs?
Warioba: No, only experience.

Magistrate: Accused, have you seen the wrapped pieces of paper?

Accused: Your Honour, they are just mere normal leaves.
Magistrate: Accused do you have any question to ask Warioba?

Accused: Yes. On the material day you arrested me, I was in the company of my colleagues. Why didn't you arrest them?

Warioba: They were not involved in the offence.
Accused: You are telling lies; the truth is that my friends gave you money and that is why you left them.

On telling you I had no money to give to you, you decided to take me to the police station.

Magistrate: Is it true Warioba?
Warioba: No.

Magistrate: Prosecutor, do you have any question?
Prosecutor: No, but I only ask for adjournment of the case for another hearing date.

The case was adjourned to August 27, this year when hearing resumes.
