Director, chemist arraigned over unlawful chemical waste disposal

The managing director of Dispositek African Ltd, Karim Ladha (40) and a chemist Allan Reynolds (55) were last week arraigned before Resident Magistrate Sundi Fimbo of Kisutu Resident Magistrate`s court for unlawful disposal of chemical waste and permitting untrained personnel to handle the same among others.

Assistant Commissioner of Police (ACP) Charles Kenyella told the court that the accused, Reynolds on July 2, this year at around 7.30pm at Dispositex Africa Ltd at Chanika area in Ilala District, Dar es Salaam Region unlawfully disposed chemical wastes consisting of Sodium Sulphate, Calcite powder, Sodium Hydrochloride powder and Aluminum Fluoride without permision from the government chemist.

In the second count, it was alleged that both the accused on the same date handled the said chemicals from the Dar es Salaam Port to Dispositek African Ltd offices at Chanika without being authorized by the respective ministerial advisory board whose powers have been vested on the Chief Government Chemist.

In the third count, it was alleged that both the accused on the same date at the said factory also failed to provide protective gears to workers employed to handle the chemicals.

In the fourth count, it was alleged that on the same date and place, both accused handled chemicals without a valid certificate from the registrar, who is also Chief Government Chemist.

In the fifth count, it was alleged that on the same date and place the accused, Reynolds, failed to prevent spillages and contamination of the environment around the factory in which they are operating.

In the sixth count, it was alleged that both the accused on the same date and place used non trained personnel to handle the chemical wastes and products without the direction of the board.

In the seventh count, it was alleged that the accused, Karim, transported container No. GATU 059455-5 22G1, which contained 377 bags of chemicals.

The accused pleaded not guilty to the charges and the case comes up for mention on September 3, this year.
