Court told case facing accused mere frame up

A Dar es Salaam court last week heard a telling revelation that the criminal case facing Bernadeta Hilary (55) was a mere frame up intended to cover up an unfolding story of the coming back to life of her deceased daughter who, it was claimed, had often re-surfaced at night while alive.

The chilling revelation was made by Bernadeta when giving her evidence at Manzese Primary Court before Magistrate Matrona Luanda.

She stands accused of using abusive language against Tunu Said (77), contrary to the law.

The Prosecution through Janeth Mwanisawa who is a court clerk, claims the accused committed the offence in question on January18, this year at 8am at Kigogo in Kinondoni District.

She said her rival Tunu framed up the case and caused it to be instituted against her because the latter wanted to cover up a bitter story of Bernadetta`s deceased daughter whom Tunu claimed she frequently saw especially during night, when the deceased visited her in secrecy.

``Your Honour, Tunu has always told me that my deceased daughter often paid her a visit at night in her room.

I have been very critical of the tragic revelation, demanding to be shown my deceased daughter while alive as promised by her,`` she told the court.

``Having acknowledged it as a serious matter I also involved my other children, who also heard Tunu saying the same story and promising to call us when my deceased daughter turns up on her again,`` she went on to say.

``But it appears Tunu has failed to show us my deceased daughter Rose who died in 1997, hence caused to institute the present case against me in the event of such tragic failure,`` she claimed.

Narrating the story Bernadetta told the court that on the material day she was in her room when she heard Tunu calling her deceased daughter`s name.

Tunu told her that she had something confidential to tell her regarding her deceased daughter.

She claimed that Tunu then told her that her deceased daughter kept on troubling her at night whenever she visited her in her room.

Bernadetta further claimed that she could not contain the chilling revelation; she told her other children of the nocturnal affair as relayed to her by Tunu.

She then went back to her in the company of her children so that they too could hear the tragic story.

Bernadetta who appeared tearful when giving her testimony claimed that Tunu had promised to call and show her deceased Rose when she turns on her next.

But surprisingly she claimed that she got no answer from Tunu whenever she asked her of the latest development on the issue until when she suddenly got a letter from the police, was arrested and eventually brought to court.
