Dr Slaa wins election case

An election petition filed by some members of the Chama cha Mapinduzi seeking to unseat Karatu legislator Dr. Wilbrod Slaa was thrown out yesterday by the High Court.

Three CCM members led by Joseph Haimu filed a petition in the High Court asking the court to nullify Karatu parliamentary election results of 2005 in which Dr Slaa from the opposition Chama cha Demokrasia na Maendeleo was declared winner.

Through legal assistance of Ezra Mwaluko and Mpaya Kamala, the three CCM members had alleged in their petition that the Karatu parliamentary poll of 2005 was characterized by a number of irregularities.

They claimed that the returning officer in Karatu hurriedly announced Dr. Slaa as a successful candidate without getting all the ballot boxes and results forms.

They also claimed that the returning officer refused and denied the CCM candidate, Patrick Tsere, and his agents to lodge complaints and allegations on the result irregularities.

Delivering his judgment yesterday, Judge Robert Makaramba of the High Court said the petitioners had failed to prove even a single allegation made against the respondents and that Dr. Slaa was the duly elected Member of Parliament for Karatu Constituency.

He said the petitioners had failed to prove that the alleged irregularities affected the results.
Dr. Slaa was represented by Tindu Lisu.
