Contractor may sue Dar medical college

The company, Lucky Construction Limited, is demanding 38m/= from MUCHS as payments for successfully completing the renovation work of the Bagamoyo Teaching Unit, the property of the institute.
MUCHS has consistently dilly-dallied in effecting payment, prompting the company to contemplate seeking legal redress.
'My patience is reaching its limit.
I will take court action against them anytime from now,' Humphrey Lupenza, the company director, told the Sunday Observer mid this week.
Lupenza, whose company deals with building and civil works, contractors and hardware, said it was 'unbelievable' that such a highly reputable higher learning institution should failing to honour legal contracts.
'I fail to understand clearly how they feel when I keep on pressing them to pay my money which they promised right from day one when they floated the tender,' said the visibly agitated Lupenza.
On November 3rd, 2003, the MUCHS awarded Lucky Construction Limited a contract for renovation for Bagamoyo Teaching Unit, after the company emerged winner among several bidders.
According to the documents availed to the Sunday Observer, the tender that yielded that contract was announced on the Daily News edition of August 21st, 2003.
The documents further show that the site was handed over to the company on November 20th 2003, and thereafter, the renovation work started immediately.
By March 24th 2004, Lucky Construction Limited, had already completed its assignment and was ready to hand over the site to the project owner, MUCHS.
Contacted to comment on the issue, a senior planning and development officer at MUCHS said he was not ready to say a word since that was an administrative matter and was beyond his capacity.
I know the issue for which you are seeking information, but I can’t comment, because the principal is the right person to comment, said the officer.
Efforts to obtain a comment from the principal, Professor K. Pallangyo, have so far been unsuccessful.
His personal assistant told this paper that her boss was busy attending various meetings within the institute.
