DAR ES SALAAM-based musician Fulgency Mapunda (32) and his producer Mussa Sikabwe (39) yesterday appeared before Kisutu Resident Magistrate Court charged for allegedly abusing President of Unitede Republic of Tanzania through ‘bongofleva” composition release.

Tanzania House of Talents artistes in action at a Simtank Dealers Night event Silafrica Limited, led by Silafrica Limited and Sumaria Group founder GP Shah, hosted in Dar es Salaam at the weekend.

In the criminal case number 348 of 2016, the prosecution led by State Attorney Mkabatunzi Derick alleged that the acused have to answer the charges.

The accused are charged with the offence of transmission of obscene communication contrary to section 118(a) of the Electronic and Postal Communication Act no.3 of year 2010.

They all denied the charges and are out on bail after complying to conditions.
The court ordered the accused to secure two reliable sureties each who would sign bond of 10m/-.

Before Principal Resident Magistrate, Thomas Simba it was alleged that Mapunda and Sibakwe being an artist/musician and music producer, respectively, committed the offence.

State Attorney Mkabatunzi alleged that on unknown date in August, this year at Manzese area within Kinondoni district in Dar es Salaam, the accused by means of network service namely YouTube, knowingly did iinitiate a transmission of a song with intent to annoy his excellency President Dr. John Pombe Magufuli.

The prosecution further alleged that the accused transmitted to YouTube users a song namely “dicteta uchwara” Swahili words to mean worthless dictator.

According to the prosecution the investigation into the case is not yet complete and it was adjourned until October 12, when it comes up for mention.
